ORDER:

Seeking writ of Mandamus to declare the action of the respondents in not disposing of the representation of the petitioner, dated 06-03-2023, as illegal and arbitrary and for a consequential direction, the present writ petition is filed.

The case of the petitioner, in brief, is as follows:-

The State Government has issued a G.O.Ms.No.14, Industries & Commerce (Mines-III) Department, dated 14-03- 2022 by making the Rules regulating the grant of mining leases in respect of minor minerals and that the respondents are granting temporary permits without conducting any auction though there is no necessity of immediately or timely requirements for granting temporary permits; that on 06-03- 2023 the petitioner made a representation to the respondents requesting not to grant temporary permits for quarrying Murram/Gravel/Ordinary Earth as there are no guidelines regarding immediate or timely requirement for grant of temporary permits; that despite of receipt of representation, the respondents are issuing the temporary permits without 2 there being any conduction of auction as per the guidelines stipulated in G.O.Ms.No.14, is the only grievance in this writ petition.
Heard the learned counsel for the petitioner as well as the learned Government Pleader for Mines and Geology.
Having regard to the facts and circumstances of the case, this court deems it appropriate to dispose of the writ petition, at the stage of admission, with the following direction.
The respondents are directed to consider and dispose of the representation, dated 06-03-2023, said to have been made by the petitioner, in accordance with the law and extant Rules, within a period of four(4) weeks from the date of receipt of a copy of this order and communicate the decision taken thereon to the petitioner accordingly.
Accordingly, with the above direction, the writ petition is disposed of at the stage of admission. No order as to costs.
Miscellaneous Petitions pending, if any, shall stand closed in consequence.
