This Court finds that the present bunch of petitions has been
filed by the petitioners challenging the Regulation 10 & 12 of the
Rajasthan Electricity Regulatory Commission (hereinafter read as
'RERC')(Renewable Energy Certificate and Renewable Purchase
Obligation Compliance Framework) (Third Amendment)
Regulations, 2019 passed by the respondent No.2 - RERC vide
order dated 05.03.2019 to the extent of fixing/capping tariff at
Rs.3.14 per Unit.
2. The petitioners have also prayed for renewal of their power
Purchase Agreements (PPAs) from 01.04.2019 for the balance
useful life of the Project, as per the existing terms of the PPAs.
3. This Court finds that during pendency of the writ petition, the
parties were directed to explore the possibility of amicable
settlement.
4. This Court was informed by learned Advocate General
Mr.M.S.Singhvi on earlier date that the petitioners, if are prepared
to withdraw these petitions, their cases may be referred to RERC
for approval of their PPAs.
5. Learned Advocate General Mr.M.S.Singhvi appearing on
behalf of the respondent No.4 - Rajasthan Urja Vikas Nigam
Limited, submitted that the PPAs, which are sought to be entered
into by the petitioners with the State Government, may be

considered afresh by RERC while exercising its power under
Section 86 of the Electricity Act, 2003.
6. Learned AG has also referred to the application No.1/2023,
which has been filed and an undertaking has been given on behalf
of Rajasthan Urja Vikas Nigam Limited and DISCOMS to the extent
of filing of the application before the RERC for approval of the
PPAs without any further delay.
7. Learned counsel Ms.Susan Mathew appearing on behalf of
the Commission was asked to seek instructions on previous dates
as in what manner the PPAs, which will be filed before the
Commission, will be decided and whether the interim order passed
by this Court, will be an impediment in approving the PPAs.
8. Learned counsel submitted that the Commission has decided
to approve the PPAs in terms of compromise between generators
& Urja Vikas Nigam Limited provided the petitioners withdraw the
writ petitions and there will be no impediment only on account of
interim order passed by this Court or due to pendency of the writ
petitions, before this Court.
9. We have gone through the application, which has been
placed on record and find that learned counsel for the petitioners
have agreed to withdraw the present petitions and only a time bound direction is sought from this Court for approval of the PPAs, which are to be placed before the Commission.

We find that since the petitioners and the respondent-State and Rajasthan Urja Vikas Nigam Limited, have entered into a compromise to approach the Commission for approval of PPAs and as such we will dispose of these writ petitions by directing the parties to approach the Commission for approval of their PPAs. 11. This Court, considering the stand taken by learned counsel appearing on behalf of the Commission, deems it proper to allow the petitioners to withdraw these petitions. The Rajasthan Urja Vikas Nigam Limited would be free to approach the Commission for approval of their PPAs.
12. Learned counsel for the petitioners made a request that on approval of their PPAs by Commission, the necessary arrears, which have accrued against the respondent DISCOM, Rajasthan Urja Vikas Nigam Limited/State may also be paid in a time bound manner.
13. Learned AG, on instructions, submitted that after approval of PPAs, the arrears would be calculated as per the rates mentioned in the compromise, arrears, if any, in favour of the petitioners, would be released within an outer limit of 90 days and as such he submits that at least three months time may be granted to clear the arrears.
14. The respondent-State and Urja Vikas Nigam Limited will take appropriate steps of paying arrears to the petitioners within an outer limit of 90 days on account of approval of their PPAs.
15. This Court also directs that RERC will exercise its Powers under Sections 86 read with 62 of the Electricity Act, 2003 for approval of PPAs within 30 days of the application being filed by the Rajasthan Urja Vikas Nigam Limited.
16. Accordingly, the present bunch of writ petitions are permitted to be withdrawn with the aforesaid directions.
