Judgment & Order
Heard Mr. K Laldinliana, learned counsel for the petitioner. Also heard Mr. H. Lalchhuanawma, learned counsel for the respondent who enters appearance today for and on behalf of the respondent by filing a Vakalatnama.
This appreciation under Section 5 of the Limitation Act, 1963 filed by, Bajaj Allianz Life Insurance Co. Ltd. for condoning delay of 82 days in filing the connected appeal against the judgment and order dated 7/10/13 passed by the District Consumer Court in C.C. No. 8 of 2013. In the application in Para 2, the grounds for delay in filing the appeal have been assigned. It is submitted by the learned counsel for the appellant that the grounds assigned rather incorporated in Para 2 of the application are cogent and sufficient which prevented the appellant in preferring the appeal in time as provided by the provisions of Section 15 of the Consumer Act 1956 We have considered carefully and are of the opinion that all grounds arising contended in Para 2 are not cogent and sufficient to give the appellant opportunity to prefer this appeal before the Forum. However taking note of the grounds contained in Para (a) and (b) in particular we are constrained to allow this application to have an opportunity to place the case of the applicant before this Forum as against the judgment and order dated 7/10/13.
Application accordingly stands allowed. Misc. case stands disposed of.
