license to the 2nd respondent for providing man power as security at the 1st
respondent office by considering the representation of the petitioner dated
21-11-2024.

ORDER
This writ petition has been filed to forbear the first respondent from granting any licence to the second respondent for providing man power as security to the first respondent office.
2. Heard the learned counsel appearing for the petitioner.
3. The petitioner is the Proprietor of Shawn Security Force. While being so, the first respondent floated tender to provide watchman to the office of the first respondent on 04.11.2024 for the period from 01.12.2024 to 31.05.2025. The petitioner submitted its bid and the second respondent also submitted a bid. The tender was opened on 20.11.2024 and it was found that the second respondent was declared as L-1 and the petitioner was declared as L-2. The petitioner objected the declaration of the second respondent as L-1 on the ground that the second respondent does not possess PSARA licence which is mandatory for a security agency. However, the objection was not considered as such, the petitioner filed this writ petition.
4. Admittedly, the second respondent was declared as L-1, the licence is yet to be issued in favour of the second respondent. The petitioner without https://www.mhc.tn.gov.in/judis 2/4 W.P (MD).No.29874 of 2024 challenging the award of contract in favour of the second respondent, simply filed this writ petition forbearing the first respondent from granting licence to provide man power as security at the first respondent office. Therefore, the direction sought for by the petitioner in this writ petition cannot be granted since the second respondent has already been declared as L-1 on the tender notification issued by the first respondent, dated 04.11.2024 for providing man power as security to the first respondent office. Therefore, the writ petition is devoid of merits and it is liable to be dismissed.
5. Accordingly, the writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
