Petitioner-Anand Kumar has filed this 2nd petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.158 dated 16.08.2016, registered at Police Station Derabassi, SAS Nagar (Mohali), under Sections 406, 420 and 120-B of the Indian Penal Code.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that first petition for anticipatory bail of the petitioner was dismissed by this Court on merits vide order dated 24.01.2017. In that order, this Court has discussed the conduct of the petitioner, who did not join the investigation despite giving opportunities including the fact that he would appear before learned Sub Divisional Judicial Magistrate, Dera Bassi and the investigating officer would also 1 of 2 ::: Downloaded on - 12-03-2017 00:42:06 ::: -2- CRM-M-7676-2017 remain present in the concerned Court on the scheduled date and time. But the petitioner did not appear to join the investigation despite that order. Therefore, first petition of the petitioner was dismissed.

Now, the petitioner has filed this second petition. However, there being no change in circumstances, I do not find any merit in the second petition for anticipatory bail.

Dismissed.
