Prayer in WP.No.3215/2015:- Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents to measure and demarcate and fix the boundaries of the petitioner's plot No.39, Survey Nos.441/1C1, 441/1B2 in A.Reddihalli village, Dharmapuri Taluk and District, assigned under free house site scheme in proceedings made in 1769/94/[A] by the 3rd respondent within the time stipulated by this Court. Prayer in WP.No.3216/2015:- Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents to measure and demarcate and fix the boundaries of the petitioner's plot No.160, Survey Nos.441/1A2, 441/1B, 443/4B, 443/14A in A.Reddihalli village, Dharmapuri Taluk and District, assigned under free house site scheme in in proceedings made in Na.Ka.No.2576/91 [A] by the 3rd respondent within the time stipulated by this Court. Heard Mr.V.R.Anna Gandhi, learned counsel for the petitioners and Mr.V.Jayaprakash Narayanan, learned Special Government Pleader appearing for the respondents and with their consent, the writ petition is disposed of at the admission stage itself. Since the issue involved in the above writ petitions is one and the same, the writ petitions are disposed of by the following common order.
2.The petitioners seek for issuance of a writ of mandamus to direct the respondents to measure and demarcate the properties in question of the petitioners assigned under Free House Site Scheme.
3.According to the petitioners, they have been allotted free house sites and the pattas have also been issued in their favour in respect of the survey numbers cited supra. The petitioners have filed applications on 25.10.2014 for measuring the properties in question, demarcation of the same and laying of boundary stones. The said requests have been sent to the respondents by speed post on 25.10.2014. Since no action has been taken pursuant to the said representations, the petitioners are before this Court.
4.In the light of the above, there will be a direction to the 4th respondent to consider the petitioners' representations dated 25.10.2014 after issuing notice to the petitioners as well as to the neighbouring land owners and pass orders on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order.
5.Accordingly, the writ petition is ordered. No costs.
