Heard learned counsels for the petitioner and the State.

The petitioner is languishing in jail since 05.08.2011 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 302, 307, 452, 380, 427, 436 and 121 of the Indian Penal Code and Section 27 of the Arms, Section 3/5 of the Explosive Substances Act, Section 17 of the Criminal Law Amendment Act and Section 13 of the Unlawful Activities (Prevention) Act.

It is alleged that a mob of 18 extremists entered into the tall plaza and started indiscriminate firing in which one guard and one driver were killed. The extremists also robed firearms and other articles of tall plaza.

It is submitted by learned counsel for the petitioner that the name of the petitioner sprang up at the fag end of the investigation and there is no recovery from the petitioner nor the petitioner has been put on T.I. parade till date. Patna High Court Cr.Misc. No.960 of 2012 (3) dt.15-03-2012

2/ 2 Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Gaya in connection with Amas P.S. Case No. 31 of 2010.

Learned court below will be at liberty to cancel the bail of the petitioner if he defaults for three consecutive occasions or gets involved in similar nature of offence.
