1. Heard Shri Nitin Sharma, learned counsel for the plaintiff-petitioner.

2. The case of the plaintiff-petitioner is that the plaintiff-petitioner instituted in Original Suit No. 350 of 2026 (APV Realty Ltd. v. NPCL) seeking a decree of permanent injunction restraining the defendant, its officials, agents, contractors and representatives from commencing or carrying out any conducting work towards conversion of single point electricity connection into multi-point individual connections and a decree of mandatory injunctions was also sought.

3. In the application under Order 39 Rule 1 and 2 of CPC on 10.03.2026 notices were issued and injunction was not granted and according to the plaintiff petitioner, next date fixed is 25.05.2026.

4. In the opinion of the Court, as per the order-sheet dated 07.04.2026 page 56, now the defendants have put their appearance while filing Vakalatnama.

5. In the opinion of the Court, once the parties are themselves represented then it is for the plaintiff/ petitioner to insist the court below for grant of injunction order, thus, it is required that the court below shall consider the application under Order 39 Rule 1 and 2 CPC on the next date fixed and, in case, due to some unavoidable circumstances, post the next date.

6. Accordingly, the petition stands disposed of.
