Learned advocate for the petitioner submits that pursuant to the earlier order of rejection of the other accused persons in the month of December, 2025 and January, 2026, there has been progress in the trial: two independent witnesses have been examined and the videographer has also been examined. Learned advocate added that two independent witnesses have turned hostile and the videographer also initially did not support the prosecution's case as he was unable to read the contents of the certificate which was issued by him. Additionally, it is submitted that there are facts which reflect that the same was prepared at the police station.

Learned advocate for the State opposes the prayer for bail and produces the chemical examiner's report. The 2 report speaks that the contents of the contraband which were seized are Diacetylmorphine, 6-Monoacetyimorphine, Morphine-3-acetate, Acetylcodeine and Alprazolam. However, the same have not been quantified by the chemical examiner.

Having regard to the proposition as laid down by the Hon'ble Apex Court in Sentu Seikh v. State of West Bengal [SLP (Crl.) No. 13987 of 2025], I am of the view that further detention of the present petitioner is unwarranted in the facts and circumstances of the case.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Sahidul Islam @ Sohidul Islam shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Additional District & Sessions Judge, 2nd Court-cum- Judge, Special Court under NDPS Act, Berhampore, Murshidabad.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court and shall not leave the district of Murshidabad without prior intimation to the learned Special Court.

Accordingly, CRM (NDPS) 334 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
