MPW (Retd.,) O/ he HEALTH OFFICE ,TTD,TIRUPATI,Chittoor District, R/o Tirupati. l ...Petitioners AND The Tirumala Tirupati Devasthanams Represented by its Executive Officer Tirumala, Tirupati, Chittoor District Andhra Pradesh. ...Respondent NN Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to a) direct the respondents to release all the service benefits to the petitioners such as promotions, as per their seniority and eligibility and pension as and when they/ petitioners retire and all other service benefits as and when they arise: b) by holding the action of the respondent organization in not doing so and with holding the benefits of the petitioners solely on the ground of pendency of Writ Petition 3023/2018 despite this Hon'ble Court noticing that the show cause notice dated 11-1- 2018 issued to the petitioners contemplating to terminate the services after several years after being recruited through direct recruitment as bad, illegal, arbitrary, discriminatory, vindictiveness victimization, contrary to the directions of this Hon'ble Court dated 21-2-2018 in Writ Petition 3023/2018 and unconstitutional c) by issuance of Writ of Mandamus. IA NO: 1 OF 2020 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to direct the respondent organization/TTD to release all the benefits for which the petitioners are otherwise are entitled in Law such as giving promotions as per their seniority and eligibility and releasing their pensionary benefits as and when they/petitioners retire from service and all other service benefits as and when they arise, pending disposal of WP 1778 of 2020, on the file of the High Court. The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri J Sudheer, Advocate for the Petitioners and M/s.C Sindhu Kumari, Standing Counsel for the Respondent, the Court made the following; ORDER:
"Heard the learned counsel for the petitioners and the learned Senior Counsel forthe respondent, TTD. ~~ oe a The learned Senior Counsel requests time for filing counter to the additional affidavit filed by the writ petitioners. . The office is directed to put up the counter filed by the respondents dated 01.03.2020 in the Court bundle immediately. --- _ . .
It is open for the petitioners who retired from service to approach the respondent TTD seeking retiremental benefits notwithstanding the pendency of the writ petition and the same can be considered by the TTD in accordance with law. _ In that behalf a representation can be made by the petitioners within a week's time from today and the same can be considered by the TTD as stated above within a period of three (03) weeks from the date of receipt of such representation and the result shall be communicated immediately.
