Background
1. The Appellant filed his RTI application dt.8.3.08 with the CPIO, PGIMER, Chandigarh. He sought a certified copy of the Agenda & Proceedings of the DPC wherein the case of promotion of Jr. Accts. Officer in the Engineering Dept was approved. The CPIO replied on 4.4.08 stating that information sought by the Appellant has not been received from Nodal Officer, SHE Office of the Institute and as and when the information is received the same will be supplied. The Appellant filed an appeal dt.11.4.08 with the Appellate Authority reiterating his request for information. On not receiving any reply, the Appellant filed a second appeal dt.15.9.08 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing on January 22, 2009. However, at the request of the respondent, the matter was heard on January 21, 2009.
3. Mr.H.R.Sharma, CPIO, Mr.Naresh Virdi (Representative of Appellate Authority) represented the Public Authority.
4. The Appellant Mr.Ashok Kumar Gupta was not present during the hearing.
Decision
5. The Respondents submitted that the Appellant has been charge sheeted for mis-conduct and that due to the pending disciplinary proceedings against him, on the recommendation of the DPC, the proceedings have been kept in a sealed cover, to be opened after the disciplinary proceedings are over.
6. Since, as per CPIO's submission that the disciplinary proceedings are over and that a penalty has been imposed upon the Appellant, the Commission holds that information sought by the Appellant can be disclosed and accordingly directs the Appellant to provide a certified copy of the DPC proceedings to the Appellant within 15 days of receipt of the Order.
7. The appeal is accordingly disposed off.
