Information sought:
The Appellant sought certified copy of the Govt. order prescribing the criteria for admissions in the CENTAC courses of Engineering, MBBS and other seats of Govt. Institutions of Puducherry, in force as on date of RTI Application.
Grounds for the Second Appeal:
The CPIO has not provided the desired information.
Relevant Facts emerging during Hearing: The following were present:-
Appellant: Present through VC.1
Respondent: Coulane Satish, Supdt. & PIO, Chief Secretariat, Higher and Technical Education, Govt. of Puducherry, Puducherry present through VC.
Appellant stated that he has asked for PIO's attestation on the Gazette notification referred in the reply provided on 08.12.2017.
PIO submitted that Appellant has been adequately informed that the Gazette notification is available in the public domain. He further stated that the Commission has held in many of its earlier decisions that once information is placed in the public domain, it ceases to be under the control of public authority and the same is excluded from the purview of RTI Act.
Decision Commission observes that the instant Appeal is devoid of any merit as Appellant is insisting on attestation of a Gazette notification which in itself is a frivolous request as a Gazette notification is deemed as a legal source of information and thus do not require any attestation by the PIO.
The appeal is dismissed.
