DATE : OCTOBER 03, 2018 PER COURT The learned counsel for the applicant pointed out to the order dated 27th April, 2018 passed by this Court in Bail Application No. 195 of 2018 directing the Trial Court to dispose of the case as expeditiously as possible and in any case within a period of four months from the date of that order. The period of four months has been over by 26th August, 2018. The learned counsel for the applicant then pointed out to the pursis dated 7th June, 2018 filed by the learned A.P.P. informing the Trial Court that the evidence of the prosecution is closed. The learned counsel submits that even then the learned Judge of the Trial Court did not examine the accused persons under Section 313 of the Code of Criminal Procedure nor has taken any steps to decide the ::: Uploaded on - 03/10/2018 ::: Downloaded on - 04/10/2018 02:44:29 ::: 2 8 ba1159-18 case expeditiously.
2. Perused the order dated 27th April, 2018 passed by this Court and the pursis dated 7 th June, 2018 filed by the learned A.P.P. before the Trial Court. Though the period of about five months has elapsed after passing of the order dated 27 th April, 2018 by this Court and the period of four months has expired after the prosecution closed its evidence, it is strange to note that the learned Judge of the Trial Court did not take steps to record statements of the accused persons under Section 313 of the Code and decide the case. The learned Judge is, therefore, directed to submit the report explaining the delay in deciding the case, prior to 11 th October, 2018.
