                           W.P.No.45282 of 2018


Order:

          The present writ petition came to be filed seeking the following

relief:

     "to issue a writ, order or direction, particularly one in the
     nature of writ of mandamus, declaring the inaction on
     the part of the respondent No.2 in taking action against

the illegal constructions made by the respondent Nos.4 to 7 in the premises bearing D.No.15/454, 15/454-1 and 15/455 of Balaji Nagar-1, Proddatur Town, YSR District, as arbitrary, illegal, abdication of the statutory duty cast on him and violative of the fundamental rights guaranteed to the petitioner under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondent No.2 to demolish the illegal constructions made by the respondent Nos.4 to 7 in the premises bearing D.No.15/454, 15/454-1 and 15/455 of Balaji Nagar-I, Proddatur Town, YSR district".

2. Though various grounds are raised, the learned counsel for the petitioner would submit that though the respondents are carrying on illegal constructions, no steps are being taken by the Municipality.

3. Md.Saleem, Standing Counsel on instructions states that the respondent Nos.4 to 7 have got building permission but constructions are with certain deviations, for which provisional and confirmation orders have been issued and he states that further steps will be taken in accordance with law.

4. Recording the submissions made by the learned Standing Counsel, the writ petition is disposed of, directing the official 2 respondents to take steps to remove/demolish etc., the illegal constructions made by the unofficial respondents, in accordance with law.

5. Miscellaneous petitions if any, shall stand closed.
