This Criminal Appeal is filed tinder Section 378(1)
& (3) of Cr.P.C. seeking to set aside the judgment and
order of acquittal dated 31.10.2009 passed by the I
Addi. District and Sessions Judge, Hubli. in Sessions
Case No.79/2007 for the offences punishable under
Sections 394, 397 nw Section 34 of IPC and
consequently convict the respondents for the aforesaid
offences.
This Criminal Appeal coming on for final hearing
this day, Mohan Shantanagoudar J delivered the
following:--
JUDGMENT
The judgment and order of acquittal passed by the I AddI. District and Sessions Judge in S.C. No. 79/2007 is appealed the State.
2. The case of the prosecution in brief is that the accused no. knife. Thereafter PW I and 3 were tied b Al to A3. When P.W.3 resisted he was stabbed by Al. The gold ornaments found in the shop were bundled by the accused, immediately thereafter Al took up mobile handset and contacted somebody instructing him to bring the vehicle in front of the jewellerv shop within two minutes. A4 entered the shop and closed the shutter from inside completely. After tying both PWs- 1 and 3 the accused fled away from the scene in Mahindra Jeep while going away. the mouths of PWs- I to 3 were gagged by inserting cloth pieces. after some time PW I and 3 untied themselves and informed C.W. 1O-Basavaraj Gali, who is the owner of a nearby provisional store, who inturn informed the Police over telephone. Some persons gathered in the shop and some among them shifted the injured P.W.3 to the Vivekananda Hospital. H ubli, for treatment. Thereafter, Police came to the spot and took PWI to the Police Station wherein PW- 1 lodged complaint as per Ex. P.1. I has taken place in an attempt to commit robbery. He further submits that none of the independent witnesses are examined though the shop of PW3 is in a building consisting of 45 shops. On these among other grounds, he prays for dismissal of the appeal.
7. Sri (LA. Holeyannavar. learned counsel appearing for Respondent no. 4 supports the arguments of Sri.V.G. Patil.
8. P.W. I -the complainant in his examination in chief supports the case of the prosecution. He deposed that he lodged complaint in the Police Station after 09.30 p.m. on the date of the incident in as much as the Police took him to the Police Station for enquiry. However, in the cross-examination, he admits that the Police arrived at the scene of offence within 15-20 minutes and by that time PW-3 was shifted to the Hospital. do not find any error on the part of the Court below in this regard.
9. Ex.P.2 is the wound certificate of the injured P.W.3. The injury certificate mentioned that the injured was accompanied by Maruthi Revankar. the brother of the victim. History recorded reveals that the incident is caused at about 09.30 p.m. with a sharp object. The injury no. 1 is a grievous injury. The wound certificate does not reveal anything with regard to the incident and as to the person involved. We are conscious of the well settled legal position that history mentioned in the wound certificate may not be of much use in the light of the evidence of the eyewitnesses. However, having found that the first version of the PW 1 is suppressed, we find that non-mentioning of the assault by any of the persons, particularly when the injured was admitted to the hospital by the brother of the victim, may go in favour of the defence. From the evidence of PW3, it is clear that PW3 was in a position to give statement to the Police. The Police enquired PW3 but they did not choose to record the statement of PW3. No reason is forthcoming as to why the statement of PW3 was not recorded at that point of time. They could have taken the opinion of the Doctor and thereafter would have recorded the statement of PW3 which would have thrown some light on the true facts. Ex.P.2-injurv certificate reveals that the victim was admitted to the Hospital by the brother of PW3 namely Maruthi Revankar, whereas PW3 himself denies the said fact in his evidence.
11. Because of the aforementioned facts and circumstances. the trial Court is justified in disbelieving the version of PW I to 3.
12. It is also relevant to note that PW1 has deposed that A3 entered the shop posing himself as the Officer of the Crime Branch whereas according to PV3. it was A4 who entered the shop who posed himself as member of 'C) 9 B 9 E E 9 C) 9 - r 9C) C) C) D B C) C) CC .

learned Advocate appearing on behalf of A3 posed a question in the cross-examination of PW8 that "in case if the Commissioner is appointed by the Court for visiting the spot in question. whether PV8 will be in a position to identify the place or not?". For such a straight question, the 1.0. has stated that he cannot identi(v the place of recovery even if a Commissioner is appointed by the Court. This clearly goes to show that the recovery of the gold ornaments from the custody of A3 was not made from the place from which the same are said to have been made. Added to it, the recovery of the gold articles was not reported to the jurisdictional Court immediately after the recovery but the same was reported only on 09.03.2004 though the recovery was made on 06.03.2004. Since the 1.0. did not know the place of recovery, in our considered opinion, the trial Court is justified in disbelieving the aspect of recovery. 16. It is also curious to note that the statement of Maruthi, the brother of the victim, vho admitted the victim to the hospital. is not recorded. According to PW3, the CWIO has admitted the injured to the Hospital, but he is not examined before the Court. Apart from the same, none of the independent witnesses are examined as mentioned supra. Having regard to the totality of the facts and circumstances, the Trial Court. in our considered opinion, is justified in acquitting the accused, in as much as the case of the prosecution as putforth. is not beyond the shadow of doubt.

It is by now well settled that the High Court would not nonnally interfere with the order of acquittal if two views are possible from the material on record and if the trial Court has taken one of such two views. We find that the view taken by the trial Court is a possible view, under the facts and circumstances of the case. In view of the same and in the light of the shaky evidence on 20:
a record, no interference is called for. Appeal fails and accordingly the same stands dismissed.
