Bhati, Public Prosecutor JUSTICE DINESH MEHTA (VACATION JUDGE) Order 03/06/2019 This application for interim bail has been filed by the petitioner under Section 439 of the Cr.P.C. in connection with FIR No.302/2012, Police Station Bhupalpura, District Udaipur, for the offences under Sections 302/34, 323, 323/34, 324, 324/34 IPC & under Section 4/25 of the Arms Act.
Heard learned counsel for the petitioner and learned Public Prosecutor and also perused the material available on record.
Learned Public Prosecutor vehemently opposed this bail application.
Having regard to the facts and circumstances of the case and keeping in view the fact that petitioner's brother is getting (Downloaded on 26/06/2019 at 11:07:51 PM) (2 of 2) [CRLMB-6198/2019] married, this Court is of the opinion that the interim bail application filed by the petitioner deserves to be accepted.
Consequently, the interim bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that petitioner Dharmesh Tak S/o Late Pyarelal Tak, arrested in connection with FIR No.302/2012, Police Station Bhupalpura, District Udaipur, shall be released on interim bail till 14.06.2019; provided he executes personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court. The petitioner will surrender before the Superintendent Jail, Udaipur on 14.06.2019 before 5.00 PM.
