ORDER
1. The Appellant filed an RTI application dated 27.03.2023 seeking information on the following points:

Page 1 of 32. Aggrieved with the non-receipt of any reply from the CPIO, the Appellant filed a First Appeal on 12.05.2023. The FAA did not pass any order.
3. Due to non-receipt of any order from the First Appellate Authority, the Appellant approached the Commission with the instant Second Appeal dated 28.07.2023. Subsequently, the CPIO replied on 03.01.2024.
4. The appellant remained absent and on behalf of the respondent Ms. Sreeja Rani, Law Officer, attended the hearing through audio conference.
5. The respondent while defending their case inter alia submitted that the delay in responding to the RTI application was on account of non-receipt of the application. However, they had replied to the appellant vide letter dated 03.01.2024 that no savings bank account (A/c No. 10151/1987) was available at Sholinghur Branch. Further, the appellant vide letter dated 12.01.2024 had communicated to them that he had received adequate information and expressed his willingness to withdraw the second appeal.
6. The Commission after adverting to the facts and circumstances of the case, hearing both parties and perusal of records, observes that the respondent replied on 03.01.2024. Further, the appellant vide letter dated 12.01.2024 had communicated to respondent that he had received adequate information and expressed his willingness to withdraw the second appeal. A copy of the communication dated 12.01.2024 was marked to the Commission. In view of the above, the Commission finds no scope for further intervention in the matter. Accordingly, the appeal is dismissed as withdrawn.
Copy of the decision be provided free of cost to the parties.
