The petitioner participated in the open bid held on 6.12.2010 for the auction of a shop in the Market Committee, Mansa and after being successful deposited 25% of the bid amount. The petitioner has thereafter changed its mind and requested vide application dated 22nd December, 2010 (Annexure P-3) not to confirm the auction and refund the 25% amount deposited by it. Since no decision has been taken on that application so far, that the petitioner has approached this Court.
Having heard learned counsel for the petitioner and considering the nature of relief sought in this writ petition, however without expressing any views on the petitioner's entitlement for refund of the amount, I deem it appropriate to dispose of the same with a direction to C.W.P.No.1296 of 2011 2 respondent Nos.2 & 3 to take a decision on the petitioner's application dated 22.12.2010 (Annexure P-3) and convey to it within a period of one month from the date of receiving a certified copy of this order.
Ordered accordingly.
