For Petitioner(s) : Mr. Lokesh Kumar Sharma For Respondent(s) : Mr. R.P.Singh, AAG with Mr.Jaiwardhan Singh Shekhawat HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA Judgment / Order 05/07/2019
1. The matter comes up on review petition filed by the petitioner seeking review of the order passed by this court on 20 th July, 2018.
2. Learned counsel appearing for the review-petitioner submits that this court ought not to have directed for the periodical (Downloaded on 30/08/2019 at 09:42:08 PM) (2 of 3) [WRW-205/2018] assessment after four months as mentioned in para 5 of the order.
3. After review petition had been filed, this court issued notices to the authority as to why the LAC has not been constituted. Whereafter Learned Additional Advocate General, appearing in the matter has apprised the court and placed on record the documents as well as additional affidavit to submit that in view of the order passed by this court and in view of the guidelines dated 15.10.2012, a Local Advisory Committee(LAC) has been constituted for Ranthambhore and other sanctuaries in Rajasthan which has started functioning.
4. While this court is satisfied that the Government of Rajasthan has now constituted the Legal Advisory Committee in terms of the order dated 5.2.2019 for Mukandra Hills Tiger Reserve(MHTR), Ranthambhore Tiger Reserve(RTR) and Sariska Tiger Reserve(STR), it is expected that the Local Advisory Committee shall held meetings as directed therein, at least in every six months and take all steps as required by them in terms of the policy guidelines as laid down by the Ministry of Environment and Forest, Government of India.
5. Having noticed above, so far as the submission of learned counsel for the petitioner with regard to periodical assessment after every four months is concerned, this court finds that the periodical assessment of Nature guides by conducting the periodical workshop in terms of para 2.3.3 would be appropriate after every four months as the shops essentially is a training for Nature guides who would be acquired to understand the fanua and flora in relation to seasonal changes which may occur in the (Downloaded on 30/08/2019 at 09:42:08 PM) (3 of 3) [WRW-205/2018] Forest Reserve from time to time. Thus, the directions issued by this court of four months assessment do not call for any interference.
6. Learned counsel for the petitioner also seeks to take up all objections relating to the constitution of the LAC. However, this court does not find the said scope in the present review petition. The petitioners, however, are free to take their grievances before the State or any other Authority if they may so choose.
7. The interim order passed by this court in relation to advertisement and the admit cards issued may be taken up before the LAC and LAC would be exclusively authorized to take decision in that regard. It is further made clear that if the nature guides have any grievances or problems the same can be addressed to LAC who would examine it and take decision thereto.
8. With the said observations, the review petition stands disposed of.
