This is a transfer petition at the instance of the petitioner-wife seeking transfer of Family Suit No.425 of 2013, titled Amit Suresh Rathi vs. Kavita, pending before the Family Court, Surat, Gujarat, to the Family Court, Merta, Rajasthan.
Despite service of notice, respondent has not appeared. Hence, averments made in the transfer petition remain unrebutted.
In view of the above and also considering the hardships which will be faced by the petitioner in contesting the case at Surat, Gujarat, we deem it proper to allow the transfer petition and transfer the aforesaid case Signature Not Verified Digitally signed by from the Family Court at Surat, Gujarat to the Family Court, Chetan Kumar Date: 2014.10.11 12:05:02 IST Reason: Merta, Rajasthan, along with all records for its adjudication.
