Section 94 in Bombay Irrigation (Gujarat Amendment) Act, 1976
94. Regulation of construction and maintenance of fubewells, etc.- Notwithstanding anything contained in the Bombay Land Revenue Code or in any other law for the time being in force, no holder of any land assessed or held for the purpose of agriculture within the meaning of the said Code (hereafter in this part referred to as agricultural land) shall after the commencement of the Bombay Irrigation (Gujarat Amendment) Act, 1976 Construct, or cause or permit to be constructed, any tubewell, artesian well or borewell, exceeding forty-five metres in depth for extracting ground water except under and in accordance with the terms and conditions (including conditions relating to the maintenance of such well) of a licence issued under section 95 and the hides made under section 101.
