The instant case has been listed under the heading 'For Orders' (with defect) to pass appropriate order pertaining to defect no.3 which pertains to non-reflection of the parties name in the Annexure-6.

The interlocutory application being I.A. No.8780 of 2019 has been filed by the petitioner for ignoring the said defect on the ground that after the said defect has been pointed out by the office, requisition for getting fresh certified copy has been made but again the copy which has been supplied, without bearing the name of the parties and as such the defect may be ignored.

This Court after hearing learned counsel for the petitioner and after going across Annexure-6 which is an order passed in BPLE Case No.58 of 2015-16 against which an appeal has been filed by one Geeta Bai being BPLE Appeal No.22 of 2017-18 (Annexure-8) wherefrom it is evident that the BPLE Appeal No.22 of 2017-18 has been filed against the order passed in BPLE Case No.58 of 2015-16 against Geeta Bai, the petitioner before the appellate authority and opposite party before the original authority.

Accordingly, this Court is of the view that there is no infirmity in the order as has been annexed as Annexure-6 which pertains to the proceeding against which the appellate order has been passed by the appellate authority in BPLE Appeal No.22 of 2017-18.

In view thereof, the defect as has been pointed out by the office is ignored.

I.A. No.8780 of 2019 is allowed and disposed of.

So far as defect pertaining to typed copy of page no. 31 is concerned, learned counsel for the petitioner undertakes to remove the same in this week.
