1. Heard learned Senior Advocate Shri.Godbole for the petitioners. Our attention is invited to the order dated 18 th August 2025 of which, breach is alleged. Paragraph No.7 therein records thus:-
"7. In view of aforesaid submissions and in the facts and circumstances of the case as well as bearing in mind the Satish Sangar 1/3 ::: Uploaded on - 12/03/2026 ::: Downloaded on - 12/03/2026 20:44:40 ::: 14-CP-156-2026-IN-WP-4618-2025.doc decision taken by High Power Committee of the State chaired by Principal Secretary (Industry), we deem it appropriate to direct the State Government to issue the notification in terms of Section 32 of the MIDC Act within a period of four weeks from today. All contentions are kept open. The Writ Petitions are disposed of with liberty to the Petitioners to file a fresh Petition in respect of prayer clause (B) if occasion so arises. With the aforesaid liberty, the Writ Petitions are disposed of."
2. We, thus, find that the State Government has not complied with the order passed within the time stipulated. Learned Addl.G.P. Shri.Chandurkar appearing for the State Government expressed regret that an application for extension could not be filed. However, it is submitted that there is no intention to defy or commit any breach of the order passed by this Court. It is submitted, on oral instructions, that due to some procedural requirements, the Notification could not be issued within the time stipulated by this Court. Shri.Chandurkar, on instructions, submits that in any case, within a period of four weeks from today, the Notification in terms of paragraph No.7 of the order passed by this Court shall be issued by the State Government.
3. In view of this assurance of learned Addl.G.P., we extend the time granted by this Court to issue the Notification in terms of Satish Sangar 2/3 ::: Uploaded on - 12/03/2026 ::: Downloaded on - 12/03/2026 20:44:40 ::: 14-CP-156-2026-IN-WP-4618-2025.doc paragraph No.7 of the order dated 18 th August 2025, by further period of four weeks from today. It is made clear that if the Notification is not issued within the extended time, the petitioners would be at liberty to revive the Contempt Petition in which case we shall be constrained to call upon the concerned Officer of the State Government to personally remain present before the Court and explain the reasons for not complying with the order passed by this Court and shall also be liable for appropriate action in accordance with the provisions of the Contempt of Courts Act, 1971.
4. Liberty to the petitioners to move this Court in case the order is not complied with.
5. Contempt Petition stands disposed of.
