1. The Petitioner seeks a direction to Respondent No. 1 to grant him appointment to the post of Junior Judicial Assistant in the District & Sessions Courts, Delhi. The Petitioner had applied for the aforesaid post pursuant to Vacancy Notice No. 01/2024 dated 12th January, 2024. The Petitioner asserts that he claimed reservation under the category of Persons with Benchmark Disabilities.1
2. The Petitioner was declared a successful candidate and his name figures in the final result dated 2nd June, 2025 at Serial No. 1699 under the Other Backward Class2 (Delhi) category. Pursuant thereto, the office of the Principal District & Sessions Judge (HQs), Delhi issued an offer of appointment to the Petitioner for the post of Junior Judicial Assistant, which was duly accepted by him. Subsequently, a notification dated 26 th November, 2025 was issued, listing the candidates whose documents were 1 "PwBD"

The Petitioner's name appears at Serial No. 78 of the said list, with the objection that he had applied and was selected against the PwBD-Ors-OBC (Delhi) category, but failed to submit the OBC (Delhi) certificate.
3. The Petitioner, however, asserts that he has not availed of any benefit or concession as an OBC candidate. He mentioned OBC details in his application inadvertently. Nonetheless, since no concession was claimed under the OBC category and he was selected on the basis of his candidature under the PwBD category, he is entitled to be appointed.
4. Issue notice. Mrs. Avnish Ahlawat, Standing Counsel for GNCTD, accepts notice. At the threshold, she submits that the application form categorically records that the Applicant had applied under the OBC category with the sub-category of PH: Mental Illness. However, she submits that the issue as to whether the Petitioner would be entitled to selection solely on the basis of the PwBD category requires verification. On this aspect, she states that a short affidavit shall be filed within a period of three weeks from today. Rejoinder thereto, if any, be filed before the next date of hearing.
5. Till the next date of hearing, one post in the PwBD category for persons with mental illness in Category 'D' shall remain reserved.
6. Issue notice to Respondent Nos. 1 and 2, upon filing of process fee, by all permissible modes, returnable on the next date of hearing.
7. Re-notify on 11th February, 2026.
