Ramveer Singh vs The State Of Madhya Pradesh on 13 February, 2020

The applicant has filed this first application under Section 439 of Cr.P.C for grant of bail, who has been arrested and is in custody since 11-07-2019 in connection with Crime No.433/2010 registered at Police Station, Jaura, District Morena, for the offence punishable under Sections 294, 323, 336 of IPC and Section 25(1-A) of the Arms Act.

It is the submission of learned counsel for the applicant that it is a case of bail jump and he was earlier granted bail but because of his medical condition, as he was suffering from paralysis, he could not appear before the trial Court, and therefore, he is suffering confinement since 11.7.2019. Except the provisions of Arms Act, all offences are bailable in nature. On pretext of a false case, he is suffering confinement. Now in the changed circumstances when he is suffering paralysis and at the mercy of financial grant given under Mukhya Mantri Sahayata Kosh is taking medical treatment, therefore, chance of absconsion is remote. He learnt the lesson hard way and he would mend his ways and would not involve in any criminal activity in future. He undertakes to cooperate in trial and to perform THE HIGH COURT OF MADHYA PRADESH 2 M.Cr.C. No.3543/2020 community service.

Learned Public Prosecutor for the State opposed the prayer and prayed for dismissal of this application.

Considering the submissions advanced, looking to the facts and circumstances of the case, but without commenting on the merits of the case, the application is allowed. It is directed that the applicant shall be released on bail on his furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only), with two solvent sureties of Rs.25,000/- each to the satisfaction of Trial Court concerned.
