03.02.2026 Heard Mr. Hiran Bijoy Chakma, learned counsel for the petitioner who has filed the instant writ petition under Article 226 of the Constitution of India, assailing the notifications dated 06.10.2025 and 26.11.2025.
The learned counsel submitted that the respondents, on issuing notification dated 06.10.2025 had fixed the last date for submission of registration form on 30.11.2025, however, since the said notifications was not widely publicized the petitioner Nos. 2, 3, 8, 9, 16, 17, 18, 19, 28, 29, 30, 31, 34, 35, 40, 41, 42 and 43 were not aware of the last date so fixed and their registration as private gardeners to grow broom grass within CADC with the Forest Department under the permit system was denied.
The learned counsel also submitted that the petitioner Nos. 1, 4, 5, 6, 7, 10, 11, 12, 13, 14, 15, 20, 21, 22, 23, 24, 25, 26, 27, 32, 33, 36, 37, 38, 39, 44, 45, 46, 47, 48, 49, 50, 51, 52, 53, 54, 55, 56 and 57 are also aggrieved by the notification dated 26.11.2025 since they were required to Page No.# 10/11 be personally present to collect their registration card, which caused great hardship to them, since they had to travel from remote villages to collect their registration card.
The learned counsel further submits that the petitioners are also aggrieved by point no. 4 of the office memorandum dated 26.11.2025, wherein, the private broom grass gardeners were prohibited from collectively transporting broom grass and each gardeners was required to transport their harvest individually, which had created much hardships to the petitioners in the sale of their harvested broom grass.
On considering the submissions made by the learned counsel, issue notice to the respondents.
Ms. Lalnunhlui, learned Govt. Advocate accepts notice on behalf of respondent No. 1.
Notice be issued to respondent Nos. 2 & 3 through registered post with A/D within 1 working day returnable by 1 week.
List the matter after 1 (one) week.
The learned counsel for the petitioner had expressed urgency in the matter, by submitting that the period for harvesting of broom grass is Page No.# 11/11 during the months of February and March and prayed for a short date, he also prayed that he may be allowed to serve notice to the respondent Nos. 2 & 3 through dasti mode.
Prayer allowed, notice may be served to the respondent Nos. 2 & 3, through dasti mode and affidavit to that effect to be filed by the next date of listing.
