Petitioner has preferred the instant petition under Section 438 Cr.P.C. seeking concession of anticipatory bail in case FIR No.157, dated 30.12.1995, under Section 456/447/448/457/120-B IPC, registered at Police Station Mohali, District Mohali.

Counsel for the parties have been heard.

Petitioner is a retired Army Officer aged approximately 80 years. Having not joined trial proceedings, he was declared a proclaimed offender. It was the case made out by counsel that petitioner had proceeded abroad even prior to proclamation proceedings having been initiated i.e. in the year 1997 and the petitioner thereafter had never visited India. It was also the contention raised that co-accused already stands acquitted by the trial Court.

Against such background, petitioner had been directed to 1 of 2 ::: Downloaded on - 15-04-2018 13:50:56 ::: CRM-M-47295-2017 (O&M) -2- appear before the trial Court on or before 26.03.2018. Further directions were issued that in the eventuality of the petitioner doing so, he would be entitled to interim bail subject to satisfaction of the trial Court/Illaqa Magistrate.

During the course of hearing today, learned counsel representing the petitioner has furnished for perusal of this Court a certified copy of order dated 21.03.2018 passed by learned Chief Judicial Magistrate, SAS Nagar, Mohali and which would reflect that petitioner has duly put in appearance before the trial Court and was admitted to interim bail upon furnishing bail bonds in the sum of Rs.1 lakh with one surety in the like amount.

Certified copy of the order dated 21.03.2018 is taken on record as mark 'A'.

Petitioner having joined trial proceedings, prayer made in the instant petition is accepted. Order dated 07.03.2018 passed by this Court is made absolute.

Disposed of.
