Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.

The petitioner has been made accused for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act, in connection with Doranda P.S. Case no. 78 of 2011 corresponding to G.R. No. 952 of 2011.

The case relates to murder of one Md. Mahmood and the case was instituted by the informant, who is nephew of the deceased, stating that he had heard gunshots and he had seen the accused persons fleeing away on a motorcycle, whom he could identify, but the accused persons were not named in the F.I.R. as they were not known to the informant.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and has prayed for bail.

Learned A.P.P. for the State has opposed the prayer for bail and has pointed out upon going through the case diary that in the confessional statement of this petitioner, he had accepted his guilt and he has also been identified in T.I.P. by the informant. The confessional statement of this petitioner and co- accused would show that they are contract killers and they had taken contract for committing murder of the deceased for rupees one lakh.

In the facts of this case, I am not inclined to enlarge the petitioner, Kameshwar Singh, on bail. Accordingly, his prayer for bail is rejected.
