01.     1.     Heard learned counsel for the Petitioners and
        learned counsel for the State.

2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.114 of 2022 pending on the file of learned J.M.F.C., Banpur, arising out of Banpur P.S. Case No.127 of 2022 for commission of offences punishable under Sections 341, 323, 294, 506 and 34 of IPC r/w U/s 3, 4 and 9B of Explosive Substances Act.

It is submitted by the learned counsel that while dealing with the anticipatory bail application of the co-accused, namely, Sankar Baral and Page 1 of 2 another in ABLAPL No.4090 of 2022, this Court vide order dated 18.05.2022 had taken note of the fact that the allegation under the Explosive Substances Act is attributed to one Somanath Baral.

4. It is further submitted by the learned counsel that none of the Petitioners have criminal proclivity.

5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Taking into account the nature of allegations and the order relating to the co-accused referred to hereinabove, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature.

7. If it comes to the fore that the Petitioners have any such criminal antecedent, this order shall not be given effect to.

8. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

9. Accordingly, the ABLAPL stands disposed of.
