On the last occasion when these matters had come up before the Court, namely, 22nd August, 2019, none appeared on behalf of the plaintiff despite service. 17.s.560.2013.doc on board. It was further clarifed that if none appears on behalf of the plaintiff, the suit itself may be dismissed. A copy of the order dated 22nd August, 2019 was directed to be served on the advocates for the plaintiff by defendant No.4.
2 Today, the learned advocate for defendant No.4 has tendered a letter dated 26th August, 2019 evidencing the service of order dated 22nd August, 2019 on the advocates for the plaintiff. The said letter is taken on record and marked "X" for identifcation. 3 Despite receiving the said letter, none have appeared on behalf of the plaintiff today. It appears that the plaintiff is not interested in prosecuting the above suit. In these circumstances, the above suit, namely, Suit No. 560 of 2013 is dismissed for want of prosecution. No order as to costs.
4 Considering that the suit itself is disposed of, nothing survives in the above Notice of Motions as well as Chamber Summons and the same are disposed of accordingly. All ad-interim orders, if any, shall stand vacated forthwith.
