Information sought:
1. The Appellant filed an RTI application dated 14-07-2024 seeking the following information:CIC/BPCLD/A/2024/641324 Page 1 of 6
"Application under section 6(1) and 6(3) of Right to Information 2005. Information has been sought on the following 24 points regarding the domestic LPG distributor under Bharat Petroleum Corporation Limited in Udham Singh district of Uttarakhand state.
1. How many Sheheri Vitrak LPG are there in Udham Singh Nagar district of Uttarakhand.
2. Names and address with distributor code of each Sheheri Vitrak LPG in Udham Singh Nagar district of Uttarakhand.
3. Number of domestic LPG subsidized consumers of each Sheheri Vitrak LPG at the end of each month in the financial year 2023-24.
4. Number of domestic non-subsidized LPG consumers of each Sheheri Vitrak LPG at the end of each month in the financial year 2023-24.
5. Refill sale of subsidized 14.2 kg cylinder every month in the financial year 2023-24 by every Sheheri Vitrak LPG.
6. Refill sales of non-subsidized 14.2 kg cylinders every month in the financial year 2023-24 by every Sheheri Vitrak LPG.
7. Percentage of refill sales by each Sheheri Vitrak LPG in proportion to the number of domestic subsidized LPG consumers in each month of the financial year 2023-24.
8. Percentage of refill sales by each Sheheri Vitrak LPG in proportion to the number of domestic non-subsidized LPG consumers in each month of the financial year 2023-24.
9. How many Rurban Vitrak LPG are there in Udham Singh Nagar district of Uttarakhand.
10. Names and address with distributor code of each Rurban Vitrak LPG in Udham Singh Nagar district of Uttarakhand. ETC."
2. The CPIO furnished a reply to the Appellant on 12-08-2024 stating as under:

The other details as sought by you like distributor's code, Distributor wise number of subsidized LPG consumers and the monthly refill sales, number of non-subsidized LPG consumers and the monthly refill sales, percentage of refill sales in proportion to the number of consumers, etc. are denied under Section 8(1) d and 8(1) e of the RTI Act as the information sought is of commercial confidence and the information is not in larger public interest and that the information available regarding refill sales of each LPG Distributor is governed by the fiduciary relationship of the Corporation with its Distributors."
3. Being dissatisfied, the Appellant filed a First Appeal dated 28-08-2024. The FAA vide its order dated 29-08-2024, upheld the reply given by the CPIO CIC/BPCLD/A/2024/641324 Page 3 of 6
4. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerged during Hearing:
The following were present:-
Appellant: Mr. Vikas Kumar, appellant's authorized representative attended the hearing through video conference.
Respondent: Mr. Yogesh Pandey, DGM Marketing, (LPG), attended the hearing in person.
5. The Appellant's authorized representative stated that the appellant sought information about sale of cylinder month-wise, the number of consumers of each distributor etc. The appellant's authorized representative submitted that the sought information was denied by the respondent.
6. The Respondent submitted that as requested by the applicant, they have provided the list of their distributors to the appellant. The respondent submitted that the private suppliers may take advantage of the information by speculating the concerned region/areas, if the information about monthly sales of the distributor and the number of customers of each distributor etc., is disclosed. Hence, the sought information is exempted U/s 8(1)(d) and 8(1)(e) of the RTI Act.
Decision:
CIC/BPCLD/A/2024/641324 Page 4 of 67. The Commission, after adverting to the facts and circumstances of the case, hearing both the parties and perusal of the records, observes that the respondent gave an appropriate reply to the appellant vide letter dated 12.08.2024. Therefore, no further intervention of the Commission is required. Accordingly, the appeal is dismissed.
Copy of the decision be provided free of cost to the parties.
