ORDER
This petition is filed under Article 226 of the Constitution of India, seeking the following relief:-
"....to issue Writ of Mandamus, declaring the action of the respondents more particularly the respondents 3 and 4 in not mutating the names of the petitioners in revenue records and in not issuing the pattadar pass books and title deeds in respect of the land being a total extent of Ac.4.73 cents in Survey No.188/1 of Paradesipalem village, Visakhapatnam Rural Mandal, Visakhapatnam District despite the directions given by the 2nd respondent through proceedings Rc.No.1710/2014/D2 dated 27.6.2014 as illegal and contrary to the provisions of the A.P.Rights in Land and Pattadar Pass Books Act 1971 as also violative of Articles 14 and 300A of the Constitution of India and consequently direct the respondents to mutate the names of the petitioners in revenue records and issue pattadar pass books and title deeds in their favour in respect of the above land and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case..."
On perusal of the entire material paper filed by the petitioner, it appears that basing upon the representation made by the petitioner on 11.06.2014, the District Collector has already addressed a letter to the Tahsildar, Visakhapatnam Rural Mandal, requesting to issue mutation proceedings and pattadar passbook/title deeds in favour of the petitioner.
The main grievance of the petitioner is that in spite of the letter addressed by the District Collector/2nd respondent, the 4th 2 respondent has not proceeded further in mutating the name of the petitioner in Revenue Records and also failed to issue pattadar pass book/title deed in his favour in respect of the land to an extent of Ac.4.73 cents in survey No.188/1 of Paradesipalem Village, Visakhapatnam Rural Mandal, Visakhapatnam District.
In view of the above, without going into the merits of the case, this Court feels it appropriate to dispose of the Writ Petition by directing the 4th respondent to mutate the name of the petitioner in the Revenue records after conducting enquiry into the matter and also issue pattadar passbook and title deed in favour of the petitioner, in accordance with the letter issued by the 2nd respondent vide Rc.N.1710/2014/D2/dt.27.06.2014, if not considered within four(04) weeks from the date of receipt of copy of this order.
Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, Interlocutory Applications pending, if any, in this Writ Petition, shall stand closed.
