                     from in any manner putting up, constructing, establishing, reconstructing
                     developing or operationalizing a fish market at Market Road, Ward No.
                     22, within the limits of Dindigul Corporation, and consequently, direct
                     the respondents to identify and earmark a suitable alternative location in
                     accordance with environmental norms, public health standards and
                     principles of planned urban development.

                                                           ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The present writ petition has been filed to forbear the respondents, their men, agents, servants or anyone claiming under them from in any manner putting up, constructing, establishing, reconstructing, developing or operationalizing a fish market at Market Road, Ward No. 22, within the limits of Dindigul Corporation, and consequently, direct the respondents to identify and earmark a suitable alternative location.

The grievance of the petitioner is that he is a resident of the 2/5 https://www.mhc.tn.gov.in/judis ( Uploaded on: 10/03/2026 07:57:26 pm ) W.P(MD)No. 5884 of 2026 same locality and according to him, the respondents are trying to renovate the existing fish market, which causes environmental hazards and health issues to the public and also affects pedestrians.

3. Heard both sides and perused the records.

4. It is noticed that all along the fish market has been in existence in the same locality and the renovation work alone is proposed to be carried out. Now, the construction has also been under process. In such view of the matter, what is required to be done is only proper sanitization and no stagnation of waste, etc. Since the fish market is in existence in the same locality, we are of the view that the renovation cannot be stalled merely on the ground that it may cause environmental issues. It is to be taken care of by the respondents. Hence, there is no merit in this writ petition.

With the said observations, this Writ Petition is dismissed with a direction to the respondents that while renovating the fish market, the respondents shall ensure that no waste materials will be thrown into the 3/5 https://www.mhc.tn.gov.in/judis ( Uploaded on: 10/03/2026 07:57:26 pm ) W.P(MD)No. 5884 of 2026 residential area or other area causing environmental pollution and affecting the public health. No costs. Consequently, connected miscellaneous petition is closed.
