ORAL ORDER
18 12-04-2017I. A. No. 2685 of 2017 has been filed on 12.04.2017 by the National Council for Teacher Education (N.C.T.E), Eastern Regional Committee, Bhubneshwar through its Regional Director, seeking extension of time to comply with the order, dated 15.11.2016, passed in the present batch of cases.
By the said order, dated 15.11.2016, the N.C.T.E. was directed, inter alia, to constitute a team for the purpose of inspection of various B.Ed. Colleges in the State of Bihar. The N. C. T. E. was also directed to file an affidavit on the progress made by it in terms of the order of this Court. One and half years thereafter, when the matter was taken up on 11.04.2017, the Court noticed that there was no progress at all from the stage as it existed on the date of the order, i.e., 15.11.2016. Nor any counter affidavit was filed on behalf of the N. C. T.E. 20 The Respondents were required to file an affidavit after completion of inspection of the existing Institutions by 21.03.2017, under the orders of the Court.
Since there is absolutely no progress, in Court's conduct of the respondents is deliberately contemptuous. The inaction in my view, is wilful and deliberate. The Court, therefore, intends to initiate contempt proceeding against all concerned, who have failed in their respective roles to comply with the order, dated 15.11.2016.
Let an affidavit be filed on behalf of N.C.T.E. giving the details of the Regional Director, who was posted at the relevant point of time, particularly at the time of the passing of the order, dated 15.11.2016 as well as his tenure on the said post. The date of the posting of the present Regional Director of N.C.T.E. , Eastern Region shall also be furnished by way of affidavit for the purpose of considering appropriate action against him.
It has been pointed out by Mr. S.N. Pathak, learned counsel for the N.C.T.E. that the Member Secretary of the N.C.T.E, Delhi, is the disciplinary authority of the Regional Director, N.C. T. E., Bhubneshwar. The Court may direct, if satisfied, initiation of disciplinary action against any one found responsible for non-implementation of this Court's order.

List this case under the same heading on 01.05.2017 for the purpose of filing of the said affidavits. On that date the Court will consider formal initiation of contempt proceedings against persons responsible for non- implementation of this Court's order, dated 15.11.2016.
It is made clear that the decision on the question of guilt or punishment of persons responsible for non- compliance of the order shall certainly depend on their subsequent conduct in implementation of this Court's order, dated 15.11.2016. All the Respondents are directed to ensure prompt compliance of the order, dated 15.11.2016. The Court shall monitor progress made in this regard at regular interval.
