Section 41(3) in Bihar Disqualified Owners' (Management of Property) Act, 1952
(3)If the notice required by sub-section (1) to be issued to the District Judge in respect of any suit or proceeding is not issued, the decree or order passed in such suit or proceeding shall be voidable at the instance of the District Judge.
