Court is constrained to record that this writ application was earlier dismissed in default for non-prosecution. Court was indulgent enough to restore it but that does not seem to have made any difference because when the matter was called out, there is again none to represent the petitioner though counsel for the State is present.

In the above stated circumstance, there is no option left to the Court but to dismiss the writ application again for non - prosecution.

It is dismissed as such.
