WRIT PETITION No.33698 of 2014
ORDER:
There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under:
"... to issue order or orders or direction or writ more particularly one in the nature of writ of mandamus declaring the action of the respondents 4 and 5 in not registering the petitioners complaint dated 11.10.2014 lodged against respondent 6 and 7 and registering subsequent complaint of respondent 6 and 7 dated 14.10.2014 regd. FIR.No.224/14 as illegal, contrary to law and abuse and misuse of statutory power."
Learned Government Pleader placed on record written instructions, dated 14.11.2014 issued by the Sub-Inspector of Police, Paloncha Rural Police Station, Khammam District.
From a perusal of the said written instructions, it is revealed that pursuant to the complaint lodged by the petitioner, a case in Crime No.215 of 2014 for the offence under Sections 294(b) and 506 IPC was registered on the file of Paloncha Rural Police Station on 05.10.2014 and investigation was taken up. After completion of investigation, a charge sheet was filed on 10.03.2015. After taking cognizance of the offence, the same is taken on file vide C.C.No.175 of 2015.
Learned Government Pleader also brought to the notice of this Court that while C.C.No.175 of 2015 was pending, the parties have compromised the matter before the III Additional 2 Judicial Magistrate of First Class, Kothagudem, on 12.12.2015.
In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition since a crime has already been registered and after investigation, charge sheet was filed.
Accordingly, the writ petition is closed. No order as to costs.
Miscellaneous petitions, if any, shall also stand closed.
