1. Mr. N.R. Koyani, learned advocate for Mr. Manish Shah, learned advocate, for the petitioner drawn the attention of this court to the order dated 16.12.2015 passed in Special Civil Application No. 20440 of 2015 in the case of Shree Kamrej Vibhag Sahkari Khand Udyog Mandli Ltd. v. Income Tax Officer wherein the court on similar facts has issued notice and granted interim relief.

2. In the aforesaid premises, issue notice returnable on 29.2.2016.
