ORAL ORDER
3 18-02-2013Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
This application has been filed for the grant of regular bail to the petitioner who has been made an accused in a case registered for the offences punishable under Sections 147, 148, 149, 332, 333, 353, 307, 120(B) of the Indian Penal Code and under section 25, 26, 27 and 35 of the Arms Act, Section 3/4 of the Explosive Substance Act and section 17 of the Criminal Law Amendment Act.
The petitioner is one of the named accused in this case on being apprehended with SLR and Magazine along with others. Submission is of false implication, under similarly situated circumstances co-accuseds have already been released on bail by different Benches of this court. Further, petitioner is in custody having a few criminal cases against him and in majority of which Patna High Court Cr.Misc. No.35409 of 2012 (3) dt.18-02-2013 he is on bail.
If, it is so, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned B.K. Choudhary, Judicial Magistrate, 1st Class, Sadar Motihari, East Champaran, in connection with Kesaria P.S. Case No. 32 of 2011, with a condition to remain physically present before the court below on each and every date till disposal of the case, in case of failure on two consecutive dates without giving any reasonable explanation, the liberty granted shall be deemed to be cancelled.
