02   08.02.2021           The matter is taken up through video conferencing
                  mode.
                          Heard Mr. A. Kanungo, learned counsel for the
                  petitioner    and    Mr.     A.K.     Sharma,        learned       Additional
                  Government Advocate for the State.
                          The petitioner has filed this writ petition seeking
                  direction    to   opposite    party    no.2     to        issue   notification
                  /addendum against the accumulated vacancy against the
                  advertisement       dated    06.10.2018       or     in    alternative    any
                  supplement notification against the advertisement dated
                  06.10.2018 of the OPSC for recruitment to the post of Asst.
                  Professor (super specialty) in Orissa Medical Educational
                  Service. She further seeks direction to opposite party no.2 to
                  allow the petitioner to appear/sit in the examination to be
                  held on 14.02.2021 as notified.
                          Mr. A. Kanungo, learned counsel for the petitioner
                  contended that due to irregular recruitment made pursuant
                  to advertisement issued on 06.10.2018, a large number of
                  vacancies are available to fill up the regular posts. Therefore,
                  direction be issued to opposite party no.2 to issue fresh
                  advertisement so that the petitioner can get opportunity to
                  participate in the process of selection.
                          Mr. A.K. Sharma, learned Additional Government
                  Advocate for the State raised preliminary objection with
                  regard to the fact that the petitioner cannot have any
                  grievance before this Court seeking direction for issuance of
                  fresh advertisement to fill up the vacancies. As such, the writ
                  petition is misconceived one.
              Considering the contentions raised by learned counsel
       for the parties and after going through the records, since the
       petitioner claims for issuance of fresh advertisement for
       filling up of accumulated vacancy, this Court is not inclined to
       issue any direction. In any case, it is the authority concerned
       to decide the same for filling up of accumulated vacancy in
       accordance with law.
             With the aforesaid observation and direction, the writ
       petition is disposed of.
