UPON hearing the counsel the Court made the following
O R D E R
This Special Leave Petition arises out of the order dated 31.10.2018 passed by the High Court granting bail in respect of the offences punishable under the provisions of the Narcotic Drugs & Psychotropic Substances Act, 1985.
The petition is delayed by 471 days and the application seeking Signature Not Verified condonation of delay states that draft Special Leave Digitally signed by Dr. Mukesh Nasa Date: 2022.07.15 Petition was received from the Panel Counsel on 01.02.2019 and the 18:04:25 IST Reason:
file was entrusted to the concerned Investigating Officer for completing necessary formalities on 05.02.2019. The concerned Investigating Officer superannuated on 28.02.2019 whereafter the file went missing.
We have been apprised that the trial is presently going on and six witnesses have already been examined on behalf of the prosecution.
Considering the entirety of the circumstances, we see no reason to interfere in the matter.
We however record the statement of the learned Additional Solicitor General that the Department will take appropriate action against the concerned officials who were responsible for causing delay in preferring the Special Leave Petition.
With these observations, the Special Leave Petition is dismissed on the ground of delay.
