                                          ORDER

Date : 04-10-2019 Heard Mr. S. Deka, learned counsel for the accused-petitioner and Mr. NJ Dutta, learned Additional Public Prosecutor, Assam, appearing for the State/respondent.

This is an application, under Section 438 CrPC, seeking pre-arrest bail of the accused- petitioner, namely, Dipankar Medda, in connection with BIEO PS Case No. 14/2014 registered under Sections 120(B)/420/406 of IPC r/With the above directions, the instant writ petition stands disposed of. Sections 4/5/6 of PCMCS (Banning) Act and Section 7 of APID (In Financial Establishment) Act, 2013.

Case Diary produced has been perused.

Page No.# 2/2 Investigation is not progressed to the extent enabling this Court to take a decision today itself. However, materials so far available in the Case Diary is perused.

It has been submitted by the learned counsel for the petitioner that petitioner had appeared twice before the Investigating Officer. Mr. Dutta, learned Addl. PP also submitted that some communication are there from the investigating agency with the Registrar of Companies so far to collect some more evidence.

In such facts and circumstances of the case, this Court is of the view that the petitioner be directed to appear before the Investigating Officer in pursuance to the letter dated 27.09.2018 within 15 days from today and till he appears within the said 15 days period, the petitioner shall not be arrested.

Return the Case Diary to be resubmitted before this Court on 29.10.2019.

List the matter again on 29.10.2019.
