As per the observations made in the order dated 03.02.2026, despite service, the respondent did not make appearance on that date. Even on the subsequent date i.e. 17.03.2026, he has not made appearance. Today also, he has not appeared. As such, the respondent is proceeded against ex parte.

Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/437/2025, titled 'Vinod Vs. Anjali', filed by the respondent-husband, SONU 2026.03.23 16:26 I attest to the accuracy and authenticity of this document 2 TA-1491-2025 pending in the Family Court, Faridabad and she seeks transfer of the same to the Court of competent jurisdiction at Gurugram.

It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 02.04.2023, but no child was born from the said wedlock. However, on account of the matrimonial dispute, the parties are residing separate. The applicant is residing at Gurugram, on account of her job constraints, as she is working as 'Sales Executive' at a store with the Company, namely, Monte Carlo and is earning Rs.15-20,000/- per month. Further, it is submitted that the applicant has got lodged an FIR bearing No.97 dated 11.06.2025, under Sections 323, 34, 406, 495 and 498-A IPC, at Police Station Women West, Gurugram, wherein challan has been presented and the respondent is facing trial in the Courts at Gurugram. The distance between the two places is stated to be 80-85 kms.

In view of the submissions aforesaid, more particularly, considering the criminal case, arising from the matrimonial dispute, to be already pending in the Courts at Gurugram and the respondent facing trial in the same, wherein he is required to make appearance on each and every date of hearing and above it, considering the fact about the respondent having not come forward to resist the application, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/437/2025, titled 'Vinod Vs. Anjali', filed by the respondent-husband, stands transferred from the Family Court, Faridabad, to the Court of competent jurisdiction at Gurugram. The requisite record of the aforesaid SONU 2026.03.23 16:26 I attest to the accuracy and authenticity of this document 3 TA-1491-2025 case be sent by the Family Court, Faridabad, to the District and Sessions Judge, Gurugram.

Learned District and Sessions Judge, Gurugram, shall assign the said petition to the Family Court, Gurugram. Even, the parties are directed to appear before the Family Court, Gurugram, within a period of one month from today onwards.
