DATE : 2nd DECEMBER, 2022 P.C. :- . By this petition, the petitioner seeks quashing of the FIR,
registered vide C.R. No. 144 of 2022, with the Nerul Police Station, Navi Mumbai, for the alleged offences punishable under Sections 376(2)(n) of the Indian Penal Code.
2. Learned APP submits that the Police after investigation, have filed an 'A Summary Report' in the Magistrate Court on 16 th July, 2022. Learned APP has tendered the said report dated 2 nd bipin prithiani 2 100-wp-2723.22.doc December, 2022 of ACP Gajanan Rathod, Turbhe Division, Navi Mumbai. The said report is taken on record.
3. In view of the said report, nothing survives for further consideration in the petition. Petition stands disposed of accordingly. The petitioner is granted liberty to file a fresh application/petition, if the occasion so arises. We make it clear, that we have not heard the petition on merits.
4. The learned Magistrate to decide the 'A Summary Report' filed by the Police, as expeditiously as possible and in any event, within three months from the date of receipt of this order.
