This order shall dispose of four Civil Writ Petitions i.e. Civil Writ Petition No. 13098 of 2004 (Deepak and others versus State of Punjab and others), Civil Writ Petition No. 17104 of 2004 (Avneet Kaur versus State of Punjab and others), Civil Writ Petition No. 15517 of 2004 (Ranbir Singh and others versus State of Punjab and others), Civil Writ Petition No. 13319 of 2004 (Pawandeep Kaur and another versus State of Punjab and others). The facts are being taken from Civil Writ Petition No. 13098 of 2004.
The petitioners were admitted in Govt. Institute of Pharmaceutical Science and Engineering, Amritsar in B.Pharmacy Course. As per the brochure/prospectus, the petitioners got Civil Writ Petition No. 13098 of 2004 2 admission and continued their studies by appearing in various semesters.
As per the petitioners, there was no condition with regard to clearance of examination and examples are given of some of the students who were having supplementary in 2nd semester were allowed to sit in the 8th semester and were continuing with the studies. Even students studying diploma course and have opted for degree have been given unlimited chances. The grievance is that the petitioners were treated differently. The claim is that petitioners shall fall within the purview of atleast clearing 50% of the semesters and thus they were entitled to take the examination of 6th semester.
The petitioners had relied upon Civil Writ Petition No. 6203 of 2004 titled as Kirti Seth and others versus State of Punjab and others. where identical relief was claimed. This writ petition was also ordered to be heard alongwith CWP No. 6203 of 2004 which has been decided by this Court on 14.2.2007.
This Court after considering the rival submissions has disposed of the above noted writ petition. The operative part of which reads as under:-
"Keeping in view the stand taken by the aforesaid respondents, the respondent No. 2 - Punjab Technical University, Jalandhar is directed to declare the result of 6th, 7th and 8th semester of the petitioner subject to the petitioner's attending the requisite number of classes of 6th semester which are being held. However, it is made clear that if the petitioner fails to attend the requisite number of classes then the result so declared by the Punjab Technical University of 6th to 8th semester shall be Civil Writ Petition No. 13098 of 2004 3 liable to be cancelled by the University.
In view of the aforesaid directions issued by this Court, learned counsel for the parties state that the writ petition itself can be disposed of in terms of the said directions.
Consequently, the Civil Miscellaneous application as well as the writ petition is disposed of in terms of the aforesaid directions."
No one appears on behalf of the petitioners.
Since the writ petition claiming identical relief is disposed of, the present writ petitions are also disposed of in same terms.
