Information sought:
The Appellant filed an RTI application dated 08.05.2023 seeking the following information:
"1. यह क दयाधार (सी०जी०) नयुि त नॉन आई०ट ०आई० डीजल लोको शेड टै नी शयन-1, इलेि क के कम"चार का ऑन %र वे'ट ांसफर जनरल इलेि सट / इलेि क जनरल और ट ०आर०डी० म+ या हो सकता है अथवा नह ं स.या/पत 1 त ल/प उपल3ध कराय+।Page 1 of 4
2. यह क सीधी भत6 कोटे के अ7तग"त टै नी शयन-3 के कतने पद सी० ए:ड ड3;यू०/कैवे, डीजल, ट ०आर०डी०, ट ०आर०एस० व इलेि क जनरल, इन पांच= /वभाग= म+ %र त है, स.या/पत 1 त उपल3ध कराय+।
3. यह क दस ू रे म:डल= से कतनी अनाप/>याँ, 'थाना7तरण हे तु आप Aीमान महोदय के पास लिBबत है, स.या/पत 1 त उपल3ध कराय+।

The CPIO furnished a point-wise reply to the Appellant on 04.07.2023 stating as under:
"मद सं 02: मद सं 02 के संबंध म+ आपको अवगत कराया जाता है उ>र मIय रे लवे/1यागराज मंडल के यांJKक / कै०चै० म+ तकनीशयन ।।। के पद पर वत"मान समय म+ %रि तयाँ उपल3ध नह है।
मद सं 05: मद सं 05 के संबंध म+ आपको अवगत कराया जाता है क वत"मान म+ सी नयर तकनी शयन, तकनी शयन।, तकनी शयन ॥ एवं तकनी शयन ।।। C&W / 1यागराज कD वर यता सूHच रे लवे कD वेबसाइट www.ncr.indianrailways.gov.in -> About us-> Division-> Prayagraj Division->Personal-> Seniority list of staff पर 1का शत कर द गयी है । िजसका अवलोकन ऑनलाइन माIयम से कर सकते है।
मद सं 01,03,04& 06: उ त मद म+ मांगी गयी सूचना इस /वभाग से सBबंHधत नह ं हM।"
The CPIO furnished a point-wise reply to the Appellant on 05.07.2023 stating as under:
"मद सं0 01 आपके उपरो त आवेदन के संब7ध म+ सHू चत कया जाता है क Inter Railway Mutual Transfer व Inter Division Transfer IREC Vol.- I के पैरा 226 व 227 तथा Master Page 2 of 4 Circular No. 24 व RBE no 08/2019 के अ7त"गत Nदये गये समे कं त Nदशा नदO श के अनुसार कये जाते है। आप वहाँ से वां छत जानकार दे खे एवं डाऊनलोड कर सकते है।
मद सं० 03 1यागराज म:डल म+ दस ू रे म:डलो से आने वाले 'थाना7तरण हे तु आवेदन लंJबत नह है मद सं0 04 इलेि कल र नग, यॉJKक /वभाग काम श"ल /वभाग एवं प%रचालन /वभाग के पद पर सीधी भत6 कोटा के तहत %रि तय= नह होने के कारण 1यागराज म:डल म+ उ त /वभागो के लए आवेदन पर 'वीकृ त 1दान नह कD गई है।
मद सं० 06 अ7य म:डलो से 'वयं के अनुरोध पर 1यागराज म:डल म+ टै नी० ।।। के पद पर समाNहत करने हे तु %रि तयाँ न होने के कारण आवेदन अ'वीकृत कर Nदये गये है। वत"मान म+ टे नी शन ।।। पद हेतु कोई भी आवेदन legacy entry म+ लंJबत नह है।
आपके Tवारा मांगी गयी सूचना के संब7ध म+ अवगत कराना है क कसी IIIrd Party के बारे म+ जानकार दे ना या उनकD ल'ट उपल3ध कराना जन सूचना अHधकार अHध नयम 2005 के 8(i) (j) के अ7त"गत IIIrd Party सूचना दे य नह है। यNद आपको आपके बारे म+ जानकार चाNहए तो आप अपने 'वयं HRMD ID के माIयम से अपनी जानकार 1ाUत कर सकते है।"
Being dissatisfied, the appellant filed a First Appeal dated 19.06.2023. The FAA vide its order dated 07.07.2023, upheld the reply of CPIO.
Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerged during Hearing:
The following were present:-
Appellant: Absent.
Respondent: Shri Bhagwan Dass Agrawal, CPIO-cum-APO, attended the hearing through VC.
The Appellant did not participate in the hearing despite service of hearing notice.
The Respondent submitted that a suitable reply in terms of RTI Act has been given to the Appellant vide letter dated 04.07.2023 and 05.07.2023.Page 3 of 4
Decision:
The Commission after adverting to the facts and circumstances of the case and perusal of the records, observes that a suitable reply in terms of RTI Act has been given by the Respondent vide letters dated 04.07.2023 and 05.07.2023. Moreover, the Appellant has not participated in the hearing to contest the same. No intervention of the Commission is required in the instant case.
The appeal is disposed of accordingly.
