1. Petitioner has preferred this writ petition (parole) seeking release on fourth regular parole for forty days.

2. It is contended by counsel for the petitioner that the parole order was rejected on the ground of furnishing of wrong address. As per the directions of the Court, the present address of petitioner was verified and verification report was submitted by the police, which is taken on record.

3. Learned Assistant Government Advocate has opposed the writ parole.

4. We have considered the contentions.

5. Since the only ground of rejection of writ parole was of furnishing wrong address, now the correct address is available on record, petitioner has availed three regular parole earlier also and had surrendered before the concerned Authorities in due time, his conduct is found to be satisfactory and he has already remained in custody for more than eleven years and is presently in Open Jail, hence, we deem it proper to allow the fourth regular parole.

6. Consequently, the writ petition (fourth regular parole) stands allowed and petitioner is released on fourth regular parole for forty days. The recommendation of the Parole Advisory Committee dated 08.03.2022 qua the present petitioner is quashed. The Jail Authorities are directed to release the petitioner on fourth regular parole for a period of forty days, on furnishing his personal bonds of Rs.50,000/- with one surety of like amount to the satisfaction of the concerned Authorities with the stipulation that he shall surrender himself before the Jail Authority on expiry of forty days. and shall maintain peace and tranquility during parole period.

7. In case of failure to surrender by petitioner on stipulated date, the Jail Authority shall proceed in accordance with law.

8. A copy of this order be sent to the Jail Authorities as well as the petitioner through Jail Authority for compliance.
