The petitioner is an accused in connection with NCB Crime No. 10/NCB/Ranchi/2021.
It has been alleged that a vehicle was intercepted by the NCB Officials and driver as well as another person sitting besides the driver were apprehended. On search of the vehicle, in nine cartoons, Phensedyl cough syrup 798 bottles each 5 ml. were seized.
It has been submitted by the learned counsel for the petitioner that the truck bearing registration no. UP65DT8411 belongs to the petitioner. It has further been submitted that the truck of the petitioner was hired for transportation of Ravgud from Shree Ghanshyam Sugar Industry, Lakhimpuri-Kheri to R.K. Agarwal & Sons, Kolkata. It has further been submitted that the petitioner was never aware about the transportation of Phensedyl cough syrup. It has also been submitted that the petitioner is in custody since 01.12.2021.
Learned counsel for the NCB has opposed the prayer for bail made by the petitioner and has submitted that the petitioner was in constant touch with the other co-accused persons, who were receivers of the Phensedyl cough syrup. He has further submitted that the case is still under investigation.
It appears that the implication of the petitioner seems to be on account of the fact that he is the owner of the truck from which a huge quantity of cough syrup was recovered.
On consideration of the aforesaid facts, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only), with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge ( NDPS), Hazaribagh in connection with NCB Crime No. 10/NCB/Ranchi/2021.
