Decision Notice
The Commission holds that the information being sought pertains to the duties being discharged by a Public
Servant in public interest and hence cannot be termed as personal information . The PIO is therefore directed
to provide the name, designation and the office address of the ticket checking staff to the Appellant .

Background
1. The RTI application dated 18.1.10 was filed by the Applicant with the PIO, ECR, Sonepur narrating about an incident which had occurred while he was traveling by train in which the ticket checking staff had issued a penalty to him for alleged traveling without a ticket and had not returned the balance amount of Rs.205/ from the Rs.500/ which the ticket checker had taken by force. The information included information related to the ticket checking staff's name, designation and address. On not receiving any reply from the FAA he filed his first appeal on 5.3.10 seeking the information once again. On 6.4.10 the PIO replied providing some information and denying the details of the ticket checking staff. Being aggrieved with this reply the Appellant filed his second appeal with the Commission on 28.6.10 seeking the same information. Decision
2. The Commission on hearing both sides holds that the information being sought pertains to the duties being discharged by a Public Servant in public interest and cannot be termed as personal information belonging to a third party. Hence the PIO is directed to provide the name, designation and the office address of the ticket checking staff to the Appellant . This information to be provided by 25th December, 2010.
3. The appeal is accordingly disposed of.
