ORDER
Information sought:
The Appellant filed an online RTI Application dated 11.11.2020 seeking information on the following two points:
"There is as Private School named as Hansraj DAV Public School, Sector-6 Panchkula, Haryana-134109, Managed by the DAV College Trust and Management Society, New Delhi which is in your limits. I would like to ask some information regarding above said school under Section 6(1) of Right to Information Act 2005. Please furnish Certified Copies of Following information Under Section 2( j)(ii)of RTI Act 2005
1) Details of the incumbents appointed on regular basis as PRT/TGT/PGT - Computer Science/Information Technology / Computer Applications/Informatics Practices/ Web Application/ Computer Teacher and their Qualifications in the session 2019 and 2020.
2) Please furnish the details by stating that Rules to be followed by Hansraj DAV Public School - CBSE Rules or DAVCMC Rules."
The CPIO vide online reply dated 08.12.2020, informed to the Appellant as under:
Being dissatisfied, the Appellant filed a First Appeal dated 08.12.2020. The First Appellate Authority vide order dated 19.01.2021, informed as under:Page 2 of 5
CIC/DSELI/A/2021/602251 Grounds for Second Appeal:
The Appellant filed a Second Appeal u/s 19 of the Act on the ground of unsatisfactory reply furnished by the Respondent. Appellant requested the Commission to direct the CPIO to provide complete information sought for.
Submissions made by Appellant and Respondent during Hearing:
The Appellant did not participate in the hearing despite being served the hearing notice.
The Respondent submitted that a point-wise reply has been given to the Appellant vide letter dated 19.01.2021.
Decision:
Upon perusal of the facts on record as well as on the basis of the proceedings during the hearing, the Commission observes that though an adequate reply has been given to the Appellant qua point no. 2 of the RTI Application but Page 3 of 5 CIC/DSELI/A/2021/602251 the reply provided with respect to point no. 1 of the RTI Application seems to be inadequate and evasive. Hence, the Commission directs the present CPIO to provide revised reply on point no. 1 of the RTI Application to the Appellant, after obtaining the same from the concerned custodian of the information, with a copy marked to the Commission, within 10 days from the date of receipt of this order.
With the above observations, the instant Second Appeal is disposed of. Copy of the decision be provided free of cost to the parties.
The Appeal, hereby, stands disposed of.
